1. Acceptance of Terms

By accessing or using https://www.eurekanav.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

EurekaNav is an AI recommendation audit and visibility monitoring service. We help founder-led B2B SaaS teams diagnose and improve AI recommendation readiness, and optionally purchase optimization services to improve their visibility in AI-powered search engines and chatbots.

3. User Accounts

  • You must provide accurate and complete information when creating an account.
  • You are responsible for maintaining the confidentiality of your account credentials.
  • You are responsible for all activities that occur under your account.
  • You must be at least 18 years old or the age of majority in your jurisdiction to use this Service.

4. Audit Submission Rules

When submitting a product for audit, you agree that:

  • You have the right to submit the product for audit and represent its owner or are the owner.
  • All submitted information (name, description, URL, screenshots) is accurate and not misleading.
  • The submitted product does not violate any laws, infringe intellectual property rights, or contain harmful content.
  • We reserve the right to decline any audit submission that violates our guidelines, at our sole discretion.

5. Paid Services & Refund Policy

Our Signal Check ($500), Full Audit ($1,500), and Sprint ($3,000) are all one-time payments. By purchasing, you agree to the following:

  • All payments are processed securely via Stripe. We do not store your payment details.
  • No refunds are offered once audit or monitoring work has commenced. If you believe you have been charged in error, contact us within 48 hours of payment.
  • We will make commercially reasonable efforts to deliver the described audit and monitoring services within the stated timeframes.
  • GEO results (such as AI engine recommendations) are influenced by third-party AI systems outside our control. We make no guarantees of specific placement or ranking outcomes.

6. Intellectual Property

The content, logos, design, and code of EurekaNav are owned by us and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

By submitting content (product descriptions, images, etc.) for audit, you grant us a non-exclusive, royalty-free, worldwide license to display and use that content in connection with our Service.

7. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or fraudulent audit requests
  • Attempt to gain unauthorized access to our systems
  • Use automated scraping tools without our written consent
  • Use our Service to spam, harass, or harm other users or businesses
  • Violate any applicable laws or regulations in connection with your use of the Service

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, EurekaNav shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion.

11. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in San Francisco, California. Each party bears its own costs unless the arbitrator rules otherwise.

12. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
