Terms of Service

1. Acceptance of Terms

By accessing or using https://www.eurekanav.com and any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

2. Description of Service

EurekaNav provides an AI Buyer Discovery Fix Sprint — a one-time diagnostic and implementation service. We identify buyer questions where AI engines mention your competitors but overlook your product, diagnose website gaps that may contribute to this, and implement fixes on up to three priority pages.

3. Service Fit Check

Before purchasing, we review each application to confirm the Sprint is a good fit. We reserve the right to decline applications where no meaningful buyer discovery gap can be identified.

4. Scope of Work

The Sprint includes:

  • Up to 5 buyer-intent prompts tested across 2–3 AI products
  • Baseline audit with competitor evidence
  • Up to 3 pages or modules modified
  • One round of feedback-based revision
  • 14-day recheck after fixes are implemented

Scope beyond the above requires a separate agreement and pricing.

5. AI Buyer Discovery Fix Sprint — Terms

The AI Buyer Discovery Fix Sprint is a one-time service priced at $299 for qualified B2B SaaS companies. Before payment, we conduct a brief fit check. By purchasing, you agree to:

  • All payments are processed securely via Stripe. We do not store your payment details.
  • Refund policy: You may cancel for a full refund before custom analysis begins. Once custom work has started, payments are not refundable for a change of mind. If we fail to deliver an agreed item, we will complete the missing work or refund the corresponding portion.
  • We deliver the Sprint within 7 business days of payment confirmation, with a recheck 14 days after fixes are implemented.
  • No guarantees on AI results: AI mentions, rankings, citations, traffic, and revenue are not guaranteed. AI engine behavior is outside our control.

6. Intellectual Property

The content, logos, design, and code of EurekaNav are owned by us and are protected by intellectual property laws. You may not reproduce, distribute, or create derivative works without our written permission.

By submitting content (product descriptions, images, etc.) for audit, you grant us a non-exclusive, royalty-free, worldwide license to display and use that content in connection with our Service.

7. Prohibited Conduct

You agree not to:

  • Submit false, misleading, or fraudulent audit requests
  • Attempt to gain unauthorized access to our systems
  • Use automated scraping tools without our written consent
  • Use our Service to spam, harass, or harm other users or businesses
  • Violate any applicable laws or regulations in connection with your use of the Service

8. Disclaimer of Warranties

The Service is provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that defects will be corrected.

9. Limitation of Liability

To the maximum extent permitted by law, EurekaNav shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

10. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without notice, if you violate these Terms or for any other reason at our discretion.

11. Operator

The Service is operated by Opulexis LLC, a limited liability company registered in the United States.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions. Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation first. If negotiation fails, disputes shall be submitted to binding arbitration under the rules of the American Arbitration Association, conducted in San Francisco, California. Each party bears its own costs unless the arbitrator rules otherwise.

13. Changes to Terms

We may update these Terms at any time. We will notify you of material changes by posting the updated Terms with a new effective date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.
